The second recorded police interview of Melody Farris was not over yet in playback for jurors. In the long conversation, she went into details in the hours leading up to her husband, Gary's, murder. The whole time she sounded as if she didn't know what could've happened to him. The detective questioning her pushed back on her for inconsistent and erroneous claims she was making. Lead Detective Daniel Hayes was heard saying: Our assumptions are based on evidence.

The jury heard detectives raising doubt in her role in Melody Farris' claims. These doubts were heard on audio recording of her second extended police interview. Investigators were not letting her off the hook. They were catching her on lies, denials and even distortions about her alleged role in Gary's murder and why his corpse was found burning up in a pile of debris on the family farm. Toward the end of this interview, the defendant sounded frustrated at the two detectives questioning her.

Opening statements began with the story of how child abuse at home gradually led to a family homicide. Six-year-old Corey Micciolo lost his life by blunt force trauma suffered when his father, Christopher Gregor, forced him to run on a treadmill because he was too fat. The defendant was charged with first-degree murder and endangering the welfare of a child. He faced a maximum Penalty of 40 years in prison.

Prosecutors began their evidence to the Jury with testimony from Corey Micciolo's mother. She confirmed that the defendant, Christopher Gregor, entered Corey's Life when he was 5-years-old. Jurors learned of the family drama Corey was born in. Breanna Micciolo was only 17-years-old and in the 11th grade dealing with a methamphetamine addiction when Corey was born. His father, Gregor, didn't even know he was the father until he was 5-years-old.

The Jury learned about the emotions of a mother who was in fear of her young child's life. Just weeks before Corey Micciolo died, just after a hospital visit, Breanna Micciolo, had to file an emergency order of protection to get full custody away from Christopher Gregor, Corey's dad. The defendant was initially charged with child neglect, based in part on the treadmill video police reviewed. After his arrest for murder, Gregor rejected the State's plea deal of a 30-year prison sentence.

The Infamous video of the treadmill abuse of young Corey Micciolo was shown in full to the jury. His father, Christopher Gregor, told detectives that he pushed his son hard in the Fitness Center because he was concerned about his weight. Apparently, Corey was getting too fat. Next, what life was like in the last weeks of this six-year-old's life was relayed back to jurors. To do this--prosecutors introduced text messages between Corey's parents, Corey's bruises, and hospital visits.

While she never confessed to the murder of her husband, Melody did appear calm and collected in the recordings. She was convinced police did not have key evidence Linking her to her the murder.

The two remained loyal during the police's investigation. Nearly a year after Gary Farris' remains were found in a burn pile, his wife, Melody, was arrested for his murder. But before she was out on bond leading up to her murder trial she made several phone calls as jail inmate. Next, the lead detective in this case testified.

As he did in the guilt phase before being convicted of the murder of Jennifer Fulford, the defendant took the stand in his death penalty phase. He wanted to get back on the witness stand to make certain things known specifically his life as a federal prison inmate. Scott Nelson was determined to let the jury know about his mistreatment while incarcerated in federal prison.

Scott Nelson's defense was trying to spare his life for the capital murder of Jennifer Fulford. He took the stand in his motivation to let the jury know how maltreated he was as federal prison inmate in the past 25 years. There were clear discrepancies between the defendant and his legal team. While he wanted to testify to the jury about issues he believed they should know Nelson's lawyers thought otherwise believing it didn't help his case against life on death row.

After his testimony his defense rested their case to jurors and the State began it's rebuttal case.

The State's rebuttal case was underway. This would be the last attempt by them to convince the jury to recommend the death penalty for Scott Nelson in the murder of Jennifer Fulford. Prosecutors brought in a mental health expert who evaluated him. Three different doctors testified for the Defense's case claiming Nelson had mitigating factors that led him to murder which included serious cognitive impairment. Prosecutors wanted to challenge those assertions.
